The Advice Case “Cross-border share of municipal management services” (HU-SK) was submitted under the II call for proposals of the pilot initiative b-solutions to receive specialised consultancy by legal experts. Municipalities across the Hungarian – Slovakian border encountered difficulties in setting up the joint procurement of machines for the maintenance of public spaces in the framework if the Interreg project “Builcogreen“.

The team of the Central European Service for Cross-Border Initiatives (CESCI) was contracted by the Association of the European Border Regions (AEBR) to advise the EGTC and propose possible solutions to the hurdles identified.

After an analysis of the national provisions of both countries, CESCI’s team clarified that there are no legal obstacles to the purchase, transport and operation of the vehicles that the municipalities are willing to acquire.

The experts’ report points out that the uncertainties of the EGTC arose mainly due to a lack of knowledge of the current EU legal framework, which instead contains provisions that facilitate the operation of vehicles in all the Member States.

The Central European Service for Cross-Border Initiatives (CESCI) recommends to organize management meetings and regular conferences to facilitate a better coordination between the two national police authorities while operating rights and financial clearance of the machines should be discussed among the EGTC’S members.
