The Advice Case “Launch of a regular passenger transport, with cabotage, between Chaves and Verín” submitted by the Municipalities of Chaves and Verín (ES-PT) under the initiative b-solutions received consultancy by the expert Maria Garayo Maiztegui.

The Eurocity Chaves- Verín wants to improve the cross-border mobility through the implementation of a regular passenger transport service.

Garayo’s investigation shows that the project is prevented by:

  • the lack of legal competence of the municipalities in the field of public passenger transport provision;
  • the absence of the concept of cross-border transport in the national law of both countries;
  • the rules on “cabotage” operations included in Regulation (EC) No 1073/2009.

To overcome these hurdles, the expert proposes the following solutions:

  • the definition, agreement and legal formalisation of the cross-border project by the relevant transport authorities  and signing of a cross-border agreement on the basis of already existing provisions;
  • the adaptation of the project to international passenger transport regulations.
