Transfrontier Operational Mission (MOT) - European Grouping of Territorial Organisation Cerdanya Hospital EGTC, ES-FR

The Advice Case „Speedy mutual recognition of qualifications for healthcare professionals“ submitted by the Cerdanya Hospital EGTC (ES-FR) under the initiative b-solutions was consulted by the team of the Transfrontier Operational Mission (MOT) that helped the applicant to better identify the obstacles slowing down the recognition of qualifications of the French professionals willing to operate at the hospital.

The MOT’s analysis demonstrates that there are no specific legal constraints but rather complexities linked to the diversity of the competent national authorities in the Spanish administrative system which are in charge of the recognition of foreign qualifications.

Different possible solutions are proposed in the final report:

  • to amend the current Spanish Law to introduce a "non-response" period, following the French example, after which – in absence of an answer from the competent authority – the professional can start operating;
  •  to delegate the recognition of diplomas to the local medical agencies;
  • to introduce the possibility to second an official from the Ministry of Education to the Cerdanya Hospital, who will certify directly on the spot the conformity of the qualifications of French doctors.
