The Advice Case “Juridical obstacles in establishment and financing of trans-national business incubator” submitted by the Lazdijai District Municipality (LT) in the course of the II call for proposals of the initiative b-solutions’ was selected to receive consultancy by the expert hired by the Association of European Border Regions (AEBR), Marcin Krzymuski.

He contributed to better identify the legal/administrative provisions preventing the establishment of a cross-border business incubator and proposed consequent solutions.

The analysis provided points out that the main hurdle lies in the absence of proper indications on this matter within the current legal framework of the two countries. In particular, the existing provisions pose limits to the financing of infrastructures (or parts of them) abroad.

In light of this, three are the possible solutions proposed by the expert Marcin Krzymuski:

• a change of interpretation of the current national provisions, making the spirit of cooperation prevailing. This would be possible in consideration of already existing bilateral treaties between the two countries;
• the creation of a joint legal entity under an intergovernmental agreement;
• the establishment of a European Grouping for Territorial Cooperation (EGTC) or of a European Economic Interest Grouping (EEIG).
