We are pleased to invite you to a dedicated TEHDAS2 workshop on Intellectual Property (IP) Rights and Trade Secrets in the context of secondary use under the European Health Data Space (EHDS).

The objective of the workshop is to clarify stakeholder needs and concerns, translate the EHDS legal framework into practical measures, and identify areas where further EU-level guidance or coordination may be required.
The TEHDAS2 Workshop on IP-Rights and Trade Secrets will be held on Thursday, 12 March 2026, in Brussels, Belgium.

Please note that this is a preliminary programme, and changes may be made until the workshop. The final programme will be updated in this invitation.
The workshop will be structured around three main thematic blocks, as outlined below.
Block 1 – Setting the Scene: Policy, Practice and Ongoing Work
This opening session will frame the discussion by providing a common understanding of the current policy and implementation landscape.
Outcome: Shared understanding of the legal, policy and operational context for IP and Trade Secret protection in EHDS secondary use.
Block 2 – Stakeholder Needs and Expectations
This session will be dedicated to gathering insights, expectations and challenges from key stakeholder groups involved in EHDS secondary use.
Contributions are expected from:
- Health data holders (industry)
- Health data holders (academia)
- Health Data Access Bodies (HDABs)
- Health data users
The session may include short stakeholder presentations followed by a moderated panel discussion.
Outcome: A synthesis of stakeholder needs and challenges to inform and guide the technical discussions in the afternoon sessions.
Block 3 – Operationalising IP and Trade Secret Protection Along the EHDS Secondary Use Pipeline
This interactive block will focus on how IP and Trade Secret protection can be implemented throughout the end-to-end secondary use workflow. Discussions will be structured around key steps in the data access pipeline:
- Communication of metadata
- Assessment of data access requests by HDABs
- Data provision from data holders to HDABs
- Data analysis by users within Secure Processing Environments (SPEs)
- Publication and disclosure of results
For each step, participants will discuss necessary legal, organisational and technical measures, taking into account the perspectives of different types of data holders and users.
Outcome: A structured set of practical measures for IP and Trade Secret protection at each stage of the EHDS secondary use process, as well as identification of open issues requiring further guidance, model clauses or EU-level coordination.
